1. Service Overview

ProbablyFair.org ("we", "our", "the Company"), a subsidiary of HYPR PTE. LTD., provides a cloud-based browser automation infrastructure service ("Infrastructure Service") and software adapters ("Adapters") that enable users to automate their own authorized online activities. We are a technology infrastructure provider, similar to cloud computing platforms.

Important: We provide the technological infrastructure only. Users are solely responsible for how they use our service and must ensure their usage complies with all applicable laws and third-party terms of service.

2. Infrastructure as a Service (IaaS)

2.1 What We Provide

  • Secure cloud browser instances
  • Proxy network infrastructure
  • Session management capabilities
  • API access to automation features
  • Software adapters for specific platforms

2.2 Technology Neutrality

Our infrastructure is technology-neutral. Like a web browser, cloud server, or internet service provider, we provide tools that can be used for various purposes. We do not control, endorse, or take responsibility for the specific ways users choose to employ our infrastructure.

3. User Responsibilities and Authorization

3.1 Required User Authorization

By using our service, you represent and warrant that:

  • You have full authorization to access any accounts you connect to our service
  • You are the rightful owner of all credentials you provide
  • Your use of our service complies with all applicable laws and regulations
  • Your use does not violate any third-party terms of service
  • You are of legal age to enter into this agreement

3.2 Prohibited Uses

You may NOT use our service to:

  • Access accounts you do not own or have explicit permission to access
  • Violate any laws, regulations, or third-party rights
  • Engage in fraud, deception, or misrepresentation
  • Circumvent security measures or access controls
  • Harm, interfere with, or disrupt any services or networks

4. Separation of Infrastructure from Usage

We operate as a neutral infrastructure provider. Just as:

  • Internet service providers are not liable for how users use the internet
  • Cloud computing platforms are not responsible for applications hosted on their servers
  • Web browsers are not accountable for websites users visit

We are not responsible for how users choose to use our automation infrastructure. Users bear full responsibility for ensuring their usage is legal, authorized, and compliant with all applicable terms.

5. Account Security

5.1 Credential Protection

We implement industry-standard security measures including:

  • AES-256-GCM encryption for stored credentials
  • Secure OAuth authentication
  • Regular security audits
  • Isolated browser environments

5.2 Your Security Obligations

You are responsible for maintaining the security of your account and any credentials you provide to our service.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

We are not liable for any consequences arising from your use of our infrastructure, including but not limited to account restrictions, suspensions, or legal actions taken by third parties.

7. Indemnification

You agree to indemnify, defend, and hold harmless ProbablyFair.org, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your use of our service or violation of these terms.

8. Service Modifications and Termination

We reserve the right to modify, suspend, or terminate our service at any time. We may also terminate or suspend your access for violation of these terms or for any other reason at our sole discretion.

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of Singapore, where our parent company HYPR PTE. LTD. is registered, without regard to conflict of law principles.
